These Terms and Conditions ("Terms") govern your use of the Shirt City website (www.shirtcity.com.au) ("the Site") and any purchase of goods or services from us. By accessing the Site or placing an order, you agree to be bound by these Terms.

1. About Us

Shirt City is operated by The Ishigami-Sims Family Trust trading as Shirt City (ABN 37 295 801 915) ("Shirt City", "we", "us", "our"), based at Unit 4, 7 Hennessy Road, Bunbury WA 6230, Australia. You can contact us at support@shirtcity.com.au or +61 89791 3824.

2. Eligibility

By placing an order, you confirm that you are at least 18 years of age, or are placing the order with the consent of a parent or guardian, and that the information you provide is accurate and complete.

3. Products and Services

Shirt City supplies apparel and decoration services including embroidery, heat transfer (DTF), vinyl cut-and-press, and sublimation printing. All goods are decorated to order based on the artwork, sizing, and quantity you specify at checkout.

We make every effort to display product colours, finishes, and stitch or print results accurately. However, some variation between on-screen images and the finished product is normal due to monitor settings, garment dye lots, and the nature of decoration processes. This variation does not constitute a defect.

4. Orders and Acceptance

When you place an order, you make an offer to purchase. We will send an order confirmation by email, but this confirmation does not form a contract. A contract is formed only when we accept your order, which occurs when we begin production.

We reserve the right to refuse or cancel any order at our discretion, including where:

Stock is unavailable
There is an error in pricing or product description
Payment cannot be processed
We believe the order is fraudulent
The artwork supplied breaches clause 7 (Intellectual Property)

If we cancel an order after payment, you will receive a full refund.

5. Pricing and Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Shipping is calculated at checkout. Prices may change without notice, but changes will not affect orders we have already accepted.

Payment must be made in full at the time of order via the payment methods listed at checkout. We do not store full credit card details; payment is processed by our payment provider.

6. Custom and Personalised Goods

Because embroidery, heat transfer, vinyl, and sublimation goods are made to your specification, the following apply:

Artwork approval. Where we provide a digital proof or mock-up, production will not begin until you approve it in writing (including by email reply). Once approved, you are responsible for any errors in the approved artwork (spelling, layout, colour selection, sizing).
Set-up fees. Embroidery digitising fees, where applicable, are non-refundable once digitising has commenced.
Cancellation. Custom orders may be cancelled without charge before production begins. Once production has started, cancellation may incur a charge equal to work completed plus any materials consumed.
Change of mind. We are not required to provide a refund or exchange on custom or personalised goods for change of mind. Your rights under the Australian Consumer Law are not affected — see our Returns & Refunds Policy.

7. Intellectual Property

Your artwork

By supplying artwork, logos, text, or any other material for decoration ("Customer Content"), you warrant that:

You own the Customer Content, or have all necessary rights, licences, and permissions to reproduce it on apparel; and
The Customer Content does not infringe any third-party intellectual property, trademark, copyright, moral right, or privacy right.

You grant Shirt City a non-exclusive licence to use the Customer Content for the purpose of fulfilling your order, including reasonable use of finished product images for our own marketing (we will not use Customer Content in marketing if you ask us not to — please tell us in writing at the time of order).

You agree to indemnify Shirt City against any claim, loss, or expense (including legal costs) arising from a third party alleging that the Customer Content infringes their rights.

Our content

All other content on the Site — including our logo, the Shirt City name, product photography, written copy, and website design — is owned by or licensed to Shirt City and may not be reproduced without our written permission.

8. Production Turnaround

Stated turnaround times are estimates and begin from the date of artwork approval and cleared payment, not the date of order. Turnaround times exclude shipping. We are not liable for delays caused by:

Late artwork approval
Suppliers running out of stock
Courier or postal delays
Public holidays or peak retail periods (e.g. Christmas)
Events outside our reasonable control

If you need an order by a specific date, please tell us before ordering so we can confirm whether the deadline is achievable.

9. Delivery

See our Shipping Policy for details. Risk in the goods passes to you when the goods are delivered to the address you provided at checkout, or when made available for collection if you selected local pickup.

10. Returns, Refunds, and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

Our total liability to you for any claim is limited to the price you paid for the goods or service in question.
We are not liable for any indirect, consequential, or special loss, including loss of profit, loss of business opportunity, or loss of reputation.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

12. Privacy

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

13. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on the Site, and the "Last updated" date will reflect the most recent change. Continued use of the Site after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Western Australia, Australia. You and Shirt City submit to the non-exclusive jurisdiction of the courts of that state.
